1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The Book Summaries ("Company," "we," "us," or "our"), governing your access to and use of the website located at app.thebooksummaries.com and all related services, features, and content (collectively, the "Service").

By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Service immediately.

2. Eligibility

The Service is intended for individuals who are at least sixteen (16) years of age. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of Service

The Book Summaries provides a curated, bilingual (English and Spanish) digital catalog of over 5,500 book summaries, including key ideas, author biographies, and related editorial content. The Service is accessible through web browsers and is delivered on a subscription and free-tier basis as described in Section 5.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Account Registration and Security

To access certain features of the Service, you must create an account by providing a valid email address and creating secure credentials. You agree to:

• Provide accurate, current, and complete information during registration;
• Maintain and promptly update your account information;
• Maintain the confidentiality of your login credentials;
• Accept responsibility for all activities that occur under your account;
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

5. Subscription Plans and Billing

5.1 Free Tier

The Service offers a free tier that permits access to a limited number of book summaries per calendar month. Free tier limits are subject to change at our sole discretion. No credit card is required for the free tier.

5.2 Paid Subscriptions

Premium subscriptions ("Paid Plans") provide unlimited access to all book summaries and premium content. Paid Plans are offered on a monthly or annual billing cycle at the prices displayed on our pricing page at the time of purchase.

5.3 Merchant of Record

All payment processing is handled by Paddle.com Market Limited ("Paddle"), which acts as our Merchant of Record. By purchasing a Paid Plan, you agree to Paddle's Terms of Use and Privacy Policy. Paddle is responsible for payment processing, invoicing, sales tax, and VAT compliance on all transactions.

5.4 Automatic Renewal

Paid Plans automatically renew at the end of each billing cycle unless canceled prior to the renewal date. You will be charged the then-current subscription rate upon each renewal. You may cancel auto-renewal at any time through the Paddle customer portal or by contacting us.

5.5 Price Changes

We reserve the right to modify subscription pricing. Any price changes will take effect at the start of your next billing cycle following reasonable advance notice.

6. Cancellation and Refunds

Cancellation and refund terms are governed by our Refund Policy, which is incorporated into these Terms by reference.

7. Intellectual Property Rights

7.1 Our Content

All content available through the Service — including but not limited to book summaries, translations, editorial text, graphics, logos, user interface design, and software — is owned by or licensed to The Book Summaries and is protected by copyright, trademark, and other intellectual property laws. The compilation of all content on the Service is our exclusive property.

7.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to:

• Reproduce, distribute, publicly display, or create derivative works from our content;
• Use any data mining, scraping, or similar data-gathering methods;
• Download, copy, or store any content except through features expressly provided by the Service;
• Use the Service or its content for any commercial purpose without our prior written consent.

8. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation;
• Infringe upon the intellectual property or proprietary rights of any party;

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Book summaries are provided for informational and educational purposes only. They are condensed interpretations of published works and are not intended to serve as substitutes for the original books, nor do they constitute professional, legal, medical, financial, or other specialized advice.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE BOOK SUMMARIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to or use of (or inability to access or use) the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service;
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability exceed the greater of fifty US dollars (USD $50.00) or the total amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Book Summaries and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Sections 7, 9, 10, 11, 13, and 14 shall survive any termination of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If the dispute cannot be resolved amicably within thirty (30) days, either party may submit the dispute to the competent courts of Mexico City, Mexico.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and The Book Summaries regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

The failure of The Book Summaries to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least fifteen (15) days before they take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.
